Terms of Service
1. Introduction
These Terms of Service ("Terms") are a legal agreement between you and Jicai, Inc., a Delaware corporation that operates Amazable ("Amazable", "we", "us"). They govern your access to and use of amazable.ai and the services we provide through it (the "Services").
By creating an account or using the Services you agree to these Terms. If you do not agree, do not use the Services.
Our Privacy Policy and Acceptable Use Policy are part of these Terms.
2. Your account
You must be at least 18 years old, or the age of majority where you live, to use Amazable.
When you create an account you must give us accurate information and keep it up to date. You are responsible for keeping your login credentials secure and for everything that happens under your account. Tell us right away at hi@amazable.ai if you believe your account has been accessed without permission.
3. Using Amazable
We grant you a limited, non-exclusive, non-transferable license to use the Services in line with these Terms.
You may not:
- resell, sublicense or provide the Services to third parties;
- copy, modify, reverse engineer or attempt to extract the source code of the Services;
- bypass or interfere with usage limits, security or access controls;
- disrupt the Services or place unreasonable load on them; or
- use the Services in violation of our Acceptable Use Policy.
If you break these rules we may remove content, suspend or terminate your account.
Some features may be labeled beta or experimental. They may change, break or be removed at any time.
4. Your content
You keep ownership of the prompts, code, files and other content you upload to or create with Amazable ("Your Content").
You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, display and transmit Your Content as needed to provide, secure and improve the Services. This license ends when you delete the content or your account, except where we need to keep a copy to comply with law or in routine backups.
You are responsible for Your Content. You confirm that you have the rights needed to use it with the Services and that it does not violate these Terms or anyone else's rights.
If you send us feedback or suggestions, we may use them without any obligation to you.
5. AI output
Amazable uses artificial intelligence to generate code, designs and other output from your prompts ("Output"). As between you and Amazable, you own the Output generated for you.
Because Output is generated by AI, similar or identical Output may be generated for other users, and we do not promise that Output is unique, accurate, free of errors or free of third-party rights. Review and test Output before you rely on it or publish it.
To provide the Services we send your prompts and related content to third-party AI model providers. How that data is handled is described in our Privacy Policy.
6. Published sites and apps
Amazable lets you publish sites and apps built with the Services. You are responsible for everything you publish, including its content, what it does, the data it collects and its compliance with applicable law. We may remove or disable anything you publish that violates these Terms or our Acceptable Use Policy.
7. Paid plans
Some features require a paid plan. Prices and what each plan includes are shown at the time of purchase. Payments are processed by Stripe, and paid plans renew automatically at the end of each billing period until you cancel. Prices exclude any applicable taxes, which we add where we are required to collect them. We may change our prices, and a new price applies from your next billing period after we notify you.
8. Cancellation and refunds
You can cancel a paid plan at any time. Cancellation takes effect at the end of your current billing period, and you keep access to paid features until then. Except where required by law, fees are non-refundable.
9. Termination
You can stop using Amazable at any time. We may suspend or terminate your account if you violate these Terms, if we are required to by law, or if we discontinue the Services. When your account ends, your license to use the Services ends and you remain responsible for any fees already due. Sections 4, 5, 10, 11, 12, 13 and 14 survive termination.
10. Ownership
The Services, including our software, design, brand and content, belong to Amazable and our licensors and are protected by intellectual property laws. These Terms do not give you any rights in the Services other than the license in Section 3. The Amazable name and logo are our trademarks and may not be used without our written permission.
11. Disclaimers
THE SERVICES AND OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT OUTPUT WILL BE ACCURATE OR FIT FOR YOUR NEEDS. Third-party services you use with Amazable are governed by their own terms, and we are not responsible for them.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMAZABLE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
13. Indemnification
You will defend, indemnify and hold harmless Amazable and its officers, directors, employees and agents from any claims, damages, losses and expenses, including reasonable legal fees, arising out of Your Content, anything you publish with the Services, your use of the Services, or your violation of these Terms or applicable law.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules. Any dispute arising out of these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. You may bring claims only on an individual basis, and not as a plaintiff or class member in any class or representative proceeding.
15. Copyright complaints
If you believe content on Amazable infringes your copyright, email hi@amazable.ai with your physical or electronic signature, a description of the work, the URL of the material you are reporting, your contact details, a statement that you believe in good faith the use is not authorized, and a statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act for them. We may remove reported content and may terminate the accounts of repeat infringers.
16. Changes and contact
We may update these Terms from time to time. When we do, we will post the updated Terms on this page and change the effective date at the top. Your continued use of the Services after the updated Terms take effect means you accept them.
These Terms are the entire agreement between you and Amazable about the Services. If any part of these Terms is found unenforceable, the rest remains in effect.
